ALBUQUERQUE, N.M. (KRQE) – She pleaded no-contest for her role in a hit and run that killed an Albuquerque father and Marine while he was working underneath a car up on jacks. However, she will not be spending any time behind bars.
Jazmin Anesi was charged with vehicular homicide, but after pleading down to a lesser charge, she will be spending a year and a half on house arrest with an ankle monitor.
“The total sentence is 18 months. All of which will be on the CCP program, which is authorized at MDC,” said Bernalillo County District Court Judge Lucy B. Solimon.
Thirty-four-year-old Scott Toole was killed in October 2022 while he was working underneath a Ford Expedition held up by jacks in a neighborhood near Avenida Cesar Chavez and Yale. A PT Cruiser plowed into the SUV, knocking it off the supports and killing him.
Evidence originally pointed to a different woman behind the wheel, but witnesses reported two other women in the car, and police later shifted their focus to Anesi. Anesi was originally charged with vehicular homicide and leaving the scene, but pleaded down to conspiracy to leave the scene.
Toole’s brother spoke in court today, saying, “There are no words that can fully express the pain of losing Scott. He was a dad, a son, a brother, an uncle, a husband, a veteran, a friend a light in the lives of all who knew him. He was taken from us in an act of reckless disregard for life.”
According to Toole’s obituary, he was a registered nurse who loved the outdoors and left behind two young children. The defense said the state had no proof Anesi was driving the vehicle, while the state argued there was witness testimony, DNA evidence, and surveillance footage pointing to Anesi.
The charges against the original woman police officer thought to have committed the crime were dropped.
