Kilmar Abrego Garcia’s attorneys are asking a federal judge to dismiss the federal smuggling charges against him.

Abrego’s attorneys say he was singled out by the U.S. government, calling his case a “selective” and “vindictive” prosecution.

Abrego was sent to a prison in El Salvador before the Justice Department admitted he was deported due to an administrative error.

After a months-long legal battle, he was finally returned to the U.S. to face criminal charges.

Abrego was expected to be released from federal custody this Friday while the government decides whether to move forward with his prosecution.
