HERMANN, Mo. – Multiple people injured in a trolley crash in Hermann, Missouri, seek legal damages as they continue to recover—nearly two months later.
The Missouri State Highway Patrol crash report said that on May 3, the Hermann Trolley Company trolley was driving west on MO 100 when the driver veered off the right side of the road, overcorrected and drove off the left side of the road into a ditch.
Brooke Emshoff was one of 32 people injured in the accident. Emshoff said she tore her meniscus and has bulging discs in her back.
“They triaged everyone that was on the trolley, and it was very painful. We’re still figuring out everything that has happened because of it,” she said.
The victims came from Missouri and Illinois. They range in age from 27 up to 68. Emshoff and a few other victims have contacted attorney Ryan Krupp for help seeking damages.
“Your one responsibility is to carry people safely from point A to point B,” Krupp said.
FOX 2 called and visited the Hermann Trolley Company’s parking lot for answers but was told the person to talk to was not around. The damaged trolley, however, is still sitting in a nearby tow lot.
“The legal truth is that if you are a driver of a motor vehicle, the law imposes on you a duty that is called the highest standard of care,” Krupp said.
Emshoff is still unsure of the total impact this crash will have on her. She continues to visit the doctor every week as she recovers.
“It was a hard experience and having to do all of the follow-up, it just brings it up again,” she said.
FOX 2 called the highway patrol to find out if the driver was cited for anything related to the crash but has not heard back.
FOX 2 has learned that the driver, a 45-year-old man, was seriously injured in the wreck. He also was the only one wearing a seatbelt when the crash occurred.
