Prosecutors announced Monday, in an emergency meeting where NBC6 was exclusively present, that they would drop the charges against a friend of the Alexander brothers, who was charged alongside the twins for an assault in 2016.
This comes as jury selection for Ohad Fisherman was set to begin Tuesday. Prosecutors claimed Fisherman aided and assisted Oren and Alon Alexander in the assault of a woman inside a Miami Beach apartment in 2016.
NBC6 exclusively reported last week court records showed Fisherman claimed he had an alibi because he was supposedly on a boat around the time of the alleged New Years Eve rape.
“The associated metadata is consistent with Mr. Fisherman being on the boat during the relevant time frame,” defense attorneys said.
Records show that on New Year’s Eve, Fisherman posted a drone video of a boat along the Intracoastal Waterway, supposedly shot by Alon Alexander, capturing the sunset.
“Riding out thank you 2016… Can’t wait for what 2017 has in store for me! Wishing everyone a safe, happy and healthy NYE!!!! Thanks @alon_alexander for the video,” Fisherman posted.
Because defense attorneys announced they could potentially use the alibi theory in front of jurors, prosecutors announced Monday the video casts doubt on the defendant’s presence at the scene of the crime.
“Part of the evidence learned by the State subsequent to the filing of this case was a Facebook post which included a video purportedly placing Fisherman on a boat cruising on the water in Miami Beach at sunset on New Year’s Eve 2016, very close in time to the sexual battery incident,” Miami-Dade State Attorney Katherine Fernandez Rundle said in a statement Monday. “Also, according to Facebook records, the video was posted around 9 pm that same night.”
This alibi contributed to the prosecution’s decision to drop the case because they admit they could not prove the case against Fisherman “beyond and to the exclusion of all reasonable doubt, which is required by law.”
The charges are only being dropped for Fisherman, and the state cases against the Alexander brothers are still pending. They are currently in custody for their federal sex trafficking cases.
State attorneys stated Monday’s announcement did not affect the twin brothers’ cases, however records show the video “was filmed by Alon Alexander using his drone, which was seized by the FBI on December 11, 2024,” which puts the presence of Alon at the crime scene in question, based on the reasonings for the drop in Fisherman’s case.
Fisherman’s attorneys denied to comment Monday and told NBC6 they plan to hold a press conference on Tuesday “to announce Ohad Fisherman’s exoneration.”
The attorneys are now claiming that some evidence in the case was either lost, destroyed or never preserved. NBC6’s Chris Hush reports.
