Attorneys for the city of Hattiesburg were ready to file an agreed order Thursday in which Club Empire owners said they would permanently close the nightclub, which was declared a public nuisance by City Council in September.

The order was not ratified, however, because neither defendants nor their attorney,  James Dukes, appeared at the hearing.

Chancery Judge Rhea Sheldon said she wanted all parties present before she signed off on the order.

Club Empire is located in Hattiesburg.

Attorney Clark Hicks, speaking on behalf of the city, agreed that the defendants, namely building owner Stacy Daniels and club operator Scalia Ainsworth, the listed owner of Austin Entertainment, which leases the building from Daniels, should be present.

Hicks shared some of the club’s history of violating the conditions of previous orders and was concerned they may not fully understand what the permanent order entails.
