ALBUQUERQUE, N.M. (KRQE) – An Albuquerque rape case from the 90s that sat untouched for nearly three decades has finally come to a close.
A jury Thursday night convicted Brian Rascon of three counts of first-degree criminal sexual penetration with a firearm enhancement in connection with the assault that took place during a home invasion in July 1991, according to the Bernalillo County District Attorney’s Office.

Officials said Rascon and several masked men broke into the victim’s home searching for drugs and money. According to court documents, Rascon held the victim and her 2-year-old child at gunpoint, and Rascon and another man proceeded to rape her.
The suspects then took off, and the case remained unsolved for decades. In 2020, the sexual assault kit collected at the time of the crime was finally tested, leading to Rascon’s identification through DNA.
Rascon, now 53 years old, has 11 prior felony convictions, the DA’s office said. He faces up to 57 years in prison at sentencing.
