A Bronx man is facing second-degree murder charges for his alleged involvement in a killing that took place eight years ago.
Bronx District Attorney Darcel Clark announced the arraignemnt of Jonathan Odenthal Diaz, 31, in the shooting death of a mother who had been walking home that evening with dinner for her four sons.
He’s accused of opening fire near Boston Road and East Tremont Avenue in the West Farms neighborhood on Jan. 6, 2017. The bullets hit Cindy Diaz, 48, who had been walking home with food from McDonald’s, though she was not the intended target.
Diaz, who is no relation to her accused killer, was shot once in the chest and once in the arm. She was taken to Saint Barnabas Hospital where she later died from her injuries.
“This defendant allegedly opened fire on a public sidewalk killing a mother whose four sons were waiting for her to return home with dinner,” Clark said in a statement Wednesday. “This defendant’s alleged actions demonstrate a callous disregard for human life and resulted in the tragic death of an innocent bystander.”
Clark’s office didn’t say how police found Odenthal Diaz but according to a report in the Daily News, he was being held in federal prison for racketeering and illegal firearms.
The accused gunman is expected back in court on Nov. 13. He pleaded not guilty according to court documents. His attorney did not immediately respond to a request for comment.
