The Department of Homeland Security said it has arrested two men after an off-duty Customs and Border Patrol agent was shot during an attempted robbery in northern Manhattan Saturday.
The department alleged Miguel Francisco Mora Nunez, arrested Sunday, shot the agent in the arm and face during the attempted robbery. Federal officials also said Cristian Aybar Berroa was arrested Monday in connection with the shooting, but didn’t specify charges against either man.
Their attorney information was not immediately available.
Police said the 42-year-old federal officer was sitting with a woman on the rocks along the Hudson River around 11:53 p.m., when two men on a moped rode up.
Video posted to social media by the Department of Homeland Security shows a person getting off a moped and approaching the pair. After an apparent gun battle, one of the two men who’d been on the moped is seen limping back to it before both fled.
The DHS said the agent was in stable condition at a hospital Monday.
The federal agency released criminal histories for both men that include past charges of thefts, armed robbery and reckless driving.
An NYPD official said the investigation is ongoing.
Federal officials alleged that both men entered the country illegally from the Dominican Republic and were subject to final removal orders. They also said New York had released Aybar Berroa in 2024 after charges of grand larceny and petit larceny despite an ICE detainer request.
City jails are barred from holding people on such requests except in cases where ICE provides a warrant and when the individual is charged with one of about 170 serious crimes.
